Which stop signs are legally binding

Is a driver is breaking the law by not stopping at a stop sign in a shopping mall parking lot in Quebec? Is the shopping mall considered private property and therefore not bound by road laws?

In Quebec, the law saying you have to stop at a stop sign doesn't apply on private property — but you'll still get a hefty fine if you get caught. That section prohibits "any rate of speed or any action that can endanger human life and safety or property. Ontario is the only province where none of the rules apply on private property.

In fact, you can drive without a licence in a parking lot there. In other provinces, the rules apply on private property. I realize they are there to control traffic and are for our own safety, and I certainly stop when I see one, just wondered if it's the same since they are not on a public thoroughfare.

A: Colonie Police Lt. Ken Pero said officers generally can't ticket you for disobeying signs in parking lots, but that doesn't mean it's a good idea to ignore them. Get into a crash, and the insurance company will certainly care that the cause was a driver deciding "What the hey, I am not legally required to stop at this red octagonal sign with the white lettering. There are two exceptions: If you park in the fire lane or in a space for the disabled, police can write you a ticket.

Curtis Cox of the Guilderland police added that some roads in malls and other private property are actually town roads. The road around the Western Avenue perimeter of Crossgates Mall is a town road, he said, and the signs there are fully enforceable.

Local governments can also pass local laws requiring the traffic signs, and that too would make them enforceable. Otherwise, it would be mayhem. Fire lanes and handicapped-parking spaces are different because they are required by state and sometimes local laws.

A property owner must follow specific rules on the number of spaces for the disabled and the placement and signage for fire lanes and handicapped spaces. All that means police can and do enforce those laws on private property.

Q: The roundabout on Sand Creek Road works great to keep traffic moving, except for one thing -- the traffic light into the apartment complex. Who makes me an authority to install a traffic control device on my lawn? Not sure what the specific rules are here, but in many jurisdictions, there's a difference between a private property open to the public such as a shop, restaurant, mall Otherwise you couldn't have any rules such as smoking restrictions, minimum age, etc.

I guess the same applies to "private" parking lots, which are open to the public. It would probably be different in the case of a strictly private parking only open to residents though see answer below for exceptions. Add a comment. Active Oldest Votes. Improve this answer. I guess it really always just boils down to whatever the judge thinks, boooo loose construction! Nah, laws are more like CSV with no header row. And spaces as the delimiter. And yes, the values are strings with spaces in them.

Just FYI local municipal judges will usually side with the town, as they are little independence. What is the point of them??? At the risk of stating the obvious The purpose is Traffic Control The signs are designed to warn drivers about pedestrian activity and cross traffic, and cue them as to who should be stopping for whom. Therefore, they are a burdensome and inefficient method of cooperation. Other countries use rules of who has the right-of-way, and don't use so many stop signs.

The question is not what happens if you hit a car. The question is what happens if you don't stop at a stop sign and nobody is around except a cop or property owner. Nobody around, eh?
